The Sleep Paralysis Companion mobile application ("App") is provided by Preshit Rakshe, acting in his personal capacity from Wardha, Maharashtra, India, through the product Sleep Paralysis Companion.
This App is offered to users globally and is not operated by a U.S.-based legal entity. By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions ("Terms").
02. Eligibility and Account Use Top Index
- Age Requirement: You must be at least 18 years old to use the App.
- Accurate Information: You agree to provide accurate account information and keep it updated.
- Account Security: You are solely responsible for maintaining the confidentiality and security of your device credentials and account access.
- Authentication Providers: Account creation and sign-in are currently supported securely through Sign in with Apple and Google Sign-In.

Medical Disclaimer & Emergency Notice
Sleep Paralysis Companion is not an emergency service and does not provide clinical medical care. The App does not replace a physician, neurologist, sleep specialist, therapist, or qualified healthcare professional.
If you are in immediate physical danger, experiencing severe medical symptoms, or need urgent crisis intervention, please contact your local emergency services immediately (such as 911 in the United States or 112 in the European Union).
Sleep Paralysis Companion is a general wellness tool, not an FDA/CE-registered medical device, and does not diagnose, detect, monitor, predict, prevent, or treat sleep paralysis or any medical condition.
The App may support comfort-focused features such as reminders, calming audio soundscapes, a direct partner dial option, and a user-recorded comfort voice message. You are solely responsible for ensuring you have explicit permission before recording another person's voice or designating their phone number.
04. User Content and Comfort Messages Top Index
- Explicit Action Only: The App records audio strictly upon an explicit, manual tap of the record button.
- No Passive Overnight Monitoring: The App does not listen to, monitor, or record audio automatically in the background during sleep tracking or sleep paralysis episodes.
- Sensitive Data Caution: Do not use the personal comfort voice feature to record or store passwords, financial credentials, payment numbers, emergency medical instructions, or confidential personal data.
- User Content and Local Storage: We may provide warnings in the app about what is appropriate to send or record, but you remain responsible for what you choose to share. Personal audio recordings remain strictly on your local device and are not uploaded, synchronized, or stored on our servers. You remain responsible for what you choose to record or export.
05. Subscriptions, Free Trial, and Pricing Top Index
- Purchase Tiers: The App offers monthly subscriptions, annual subscriptions, and lifetime access options processed exclusively through Apple In-App Purchase.
- Transparent Pricing: Current pricing and billing intervals are displayed clearly in the App and on the Apple App Store prior to purchase confirmation.
- Introductory Offer / Free Trial: A 3-night introductory experience is offered where available. For billing purposes, the exact introductory trial terms and durations are governed by the configuration displayed in Apple App Store Connect.
- Automatic Renewal: Subscriptions renew automatically at the end of each billing cycle unless canceled through your Apple ID Account Subscription Settings at least 24 hours prior to the next renewal date.
Lifetime Access Terms
A Lifetime Purchase grants access to the core features and standard non-AI updates available at the time of purchase for as long as the service remains commercially and technically operational. Future AI-powered, token-based, cloud-computation, or meter-usage features may be offered separately for an additional fee. Lifetime access does not guarantee perpetual service operation in perpetuity. To the extent permitted by applicable law, we reserve the right to modify, suspend, or discontinue the service or lifetime access if maintaining infrastructure is no longer commercially or technically viable, without obligation to issue pro-rated or full refunds.
06. Billing, Refunds, and Finality of Sales Top Index
All purchases, trial conversions, renewals, and lifetime payments are handled exclusively through Apple's In-App Purchase framework (StoreKit).
All Sales Are Final: To the maximum extent permitted by applicable law, all purchases are final, non-cancelable, and non-refundable. We do not process direct billing, credit card transactions, direct refunds, or cash returns.
Any request for a refund must be submitted directly to Apple via reportaproblem.apple.com or through your Apple ID Account Settings. All refund decisions are subject entirely to Apple’s standard policies, terms, and sole discretion.
07. Apple and Google Sign-In Top Index
When you sign in using Sign in with Apple or Google Sign-In, you authorize us to use the authentication identifiers and authorized profile details provided by those platforms to create and maintain your account.
If you delete your account, we will take reasonable technical steps to disconnect and revoke the associated sign-in token where technically supported. You may also unlink connections directly in your Apple ID or Google Security Settings.
08. Direct Partner Calling Top Index
The direct partner calling feature opens your mobile device's native telephone dialer pre-filled with your saved contact number.
- No Telephony Hosting: The App does not place calls directly over VoIP servers or host telecommunication infrastructure.
- Carrier Fees & Network: Standard cellular voice minutes, carrier charges, network coverage, roaming rules, and contact availability are governed exclusively by your mobile network operator.
- No Liability for Missed Connections: We bear no liability for missed calls, network outages, unassigned numbers, or unanswered dials.
- Contact Authorization: By adding a designated partner phone number, you represent and warrant that you have lawful permission to save that number and that the recipient understands they may be called from your device.
09. Prohibited Use Top Index
You agree not to engage in any of the following prohibited actions:
- Using the App for any unlawful, harassing, defamatory, abusive, fraudulent, or deceptive purposes.
- Attempting to reverse engineer, decompile, disassemble, or bypass software security controls.
- Recording or distributing another individual’s voice or personal information without their express consent.
- Interfering with server operations, introducing malicious code, or overloading network infrastructure.
10. Service Changes and Availability Top Index
We continuously refine our services. We reserve the right to update, modify, expand, suspend, or discontinue any feature, soundscape, grounding tool, or service component at any time for operational, safety, regulatory, or technical reasons.
11. Disclaimers & "As-Is" Warranty Top Index
To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
We do not warrant that the App will be completely error-free, that audio playback will never fail due to device volume or sleep settings, or that the App will resolve every nighttime awakenings experience.
12. Limitation of Liability Top Index
To the fullest extent permitted by applicable law, in no event shall Sleep Paralysis Companion or Preshit Rakshe be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of sleep, lost profits, or data loss, arising from your use of or inability to use the App.
Our total aggregate liability for any claims arising under these Terms shall be limited to the total amount paid by you for the App or subscription in the twelve (12) months preceding the claim, or the statutory minimum amount required by law, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such jurisdictions, liability is limited to the greatest extent permitted by local law.
13. Governing Law and Disputes Top Index
These Terms shall be governed by and construed in accordance with the laws applicable to a business operated from Wardha, Maharashtra, India, without giving effect to any conflict of law principles.
Dispute Resolution & Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms shall be settled through binding individual arbitration conducted in the English language. To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in a class-action lawsuit or class-wide arbitration.
Consumer Protection Carve-Out
If you reside in a jurisdiction where mandatory arbitration, class-action waivers, or foreign governing law selection are prohibited by local consumer protection statutes, those specific restrictions will not apply to you, and your non-waivable local statutory consumer rights remain fully intact and enforceable.
14. Termination Top Index
We reserve the right to suspend or terminate your account access if you breach these Terms, if required by legal authorities, or if we discontinue service operations. You may terminate your agreement at any time by stopping all use of the App and deleting your account through our Delete Account procedure.
